Louisville Visual Art Consent, Release & Waiver of Liability *

By registering my student for a class offered by Louisville Visual Art, Inc. (LVA), I accept all parts of this Consent, Release & Waiver.

My student, a minor child under my care and authority indicated as the class enrollee in the accompanying registration documents (hereafter “Student”), accepts the invitation to Children’s Fine Art Classes (CFAC). The Student and I understand this invitation to be a recognition of the Student’s visual art promise.

Assumption of Risk

Occasionally, unforeseen individual risks and circumstances may arise during LVA classes, camps, programs, or workshops (hereafter “Class” or “Classes”). I understand that my Student’s participation in Classes, at any level, is undertaken at our own risk, with no liability on LVA’s part. I further recognize that there is a rare chance that illness, injury or even death could result from said participation. I acknowledge that I use my own capacity for assessment of risk in making decisions for myself and for children in my care, and I voluntarily make those decisions with full awareness that they may bring grave risks to me or to the children in my care. By allowing my Student to attend any Class, I expressly accept and assume any risks, injuries or damages, known or unknown, which the children under my care or I might incur as a result of participating in the Classes.

Emergency Medical Assistance

I give consent for first-aid or other emergency medical services to be applied to me or to my Student in connection with a health problem or emergency during a Class, including calling 911 or requesting an ambulance. I agree to hold Class instructors (“Instructors”), LVA, and the locations hosting any LVA Class (“Locations”) harmless as a result of any such injury or damage I or my Student may suffer due to the application of treatment, medical services, or emergency medical care.

Release of Claims

By agreeing to participate in Classes, I knowingly, voluntarily and expressly waive any claim I may have against LVA, Instructors, and Locations for any injury or damages that I or my Student may sustain as a result of participating in the Classes. I agree now to hereafter forever release LVA, Instructors, and Locations from any and all liability, damages, causes of action, allegations, suits, sums of money, claims and demands whatsoever, in law or equity, which I have ever had, now have or will have in the future, arising from my past or future participation in, or otherwise with respect to, any acts or omissions or anything related to a Class.

Role of Class Instructors

I understand and agree that the sole role of the Instructors is to organize the logistics and educational content of the Classes. Instructors are not responsible for my safety or wellbeing, nor for that of my Student.

Media Waiver

I authorize LVA to use the following information relating to me, my Student and my family: pictures – including photographic, motion picture, and electronic (video) images. I hereby grant LVA the right to use, publish, and reproduce, for all purposes pictures of my Student in film or electronic (video) form, sound and video recordings of my and my student’s voices, and printed and electronic copy of the information described above in any and all media including, without limitation, cable and broadcast television and the Internet, and for exhibition, distribution, promotion, advertising, sale, press conferences, meetings, hearings, educational conferences and in brochures and other print media. I further grant LVA all right, title, ownership and interest that I may have in all marketing and promotional pictures, negatives, reproductions, and copies of the original print, and further grant LVA the right to give, sell, transfer, and exhibit the print in copies or facsimiles thereof, for marketing, communications, advertising or for any other purpose, as it deems fit. I also understand that LVA is not responsible or liable in any way for photos that other members post on social media or otherwise share or distribute as we have no control over others’ actions. Should I object to a photo of me or my Student being posted or shared by another member, I understand that I need to contact that member directly and ask him/her to remove or take down the image as LVA is not involved or responsible for that situation.

Waiver of Liability Related to Coronavirus/COVID-19

By signing this agreement, I acknowledge the contagious nature of COVID-19 and voluntarily assume the risk that my Student or I may be exposed to or infected by COVID-19 as a result of participation in Classes and related activities and acknowledge that such exposure or infection may result in illness, personal injury, permanent disability, and/or death. I understand that my or my Student’s participation in Classes may result in exposure to or infection by COVID-19 as a consequence of the actions, omissions or negligence of me, my Student, other participants, Instructors, staff, volunteers or others near me or my Student during the Classes. I voluntarily assume all of the foregoing risks and accept sole responsibility for any injury to my Student or me (including, but not limited to, personal injury, disability, and/or death), illness, damage, loss, claim, liability, or expense of any kind, that I may experience or incur in connection with my or my child’s participation in Classes. I hereby release, covenant not to sue, discharge, and hold harmless LVA, Instructors, and Locations, of and from all liabilities, claims, actions, damages, costs or expenses of any kind arising out of or relating thereto. I understand and agree that this release includes any claims based on the actions, omissions, or negligence of LVA, Instructors, and Locations, whether a COVID-19 infection occurs before, during, or after my Student’s or my participation in any Classes or related activities.

Student Artwork Contribution and Waiver

By enrolling in CFAC, the Student and I agree that one piece of the Student’s artwork will be selected by the class Instructor for inclusion in the annual CFAC exhibit and sale fundraiser, held in spring 2022, where the selected artwork will be available for purchase by the public. I further acknowledge that I have the right to purchase the selected artwork until August 30, 2022. I waive all rights for myself and on behalf of my Student to any claims for payment, royalties or other compensation in connection with any exhibit, release, reproduction, telecast or other publication of the aforementioned material, regardless of the purpose of such exhibition, broadcast or other media representation undertaken by LVA or any designee of LVA.
